Deputies Arrest Suspect in Burglary at Atilano’s in Wandermere
Early this morning, Spokane County Sheriff’s Deputies responded to the report of a burglary at Atilano’s on N. Division Street. The manager stated he was watching a live video feed of a subject inside the business. Deputies arrived, observed a person quickly walking away from the building, and detained him. As the investigation continued, probable cause to arrest the suspect was developed. He was booked into the Spokane County Jail for Burglary 2nd Degree, Malicious Mischief 2nd Degree, and Attempted Theft 3rd Degree.
On August 11, 2023, at approximately 3:20 am, Spokane County Sheriff’s Deputies responded to a reported burglary in progress call in the 12200 block of N. Division Street, arriving minutes after the initial 911 call.
They found the business's front door shattered, the drive-through window open, and the cash register appeared to have been moved. Deputy D. Hicks checked the front of the location as Deputy K. Smith maintained a position in the parking lot. Deputy K. Smith observed a male swiftly walking away from the drive-through area and safely detained him with the assistance of Deputy Hicks.
A few minutes later, the manager arrived and showed Deputy Hicks a video of the incident. Deputy Hicks noted the suspect on the video who entered Atilano’s was indeed the same male detained by Deputy Smith. The manager estimated the loss/damage to the business to be over $1,200.
Deputy Hicks advised the male, identified as 35-year-old Robert B. Helferstay, of his rights. Helferstay agreed to answer questions and admitted to being inside the business. Deputy Hicks advised Helferstay he was under arrest for Burglary and Malicious Mischief.
Helferstay was booked into the Spokane County Jail for Burglary 2nd Degree, Malicious Mischief 2nd Degree, and for warrants charging him with Obstructing, Making False Statements (2 counts), and Theft 3rd Degree. Helferstay has 2 prior felony convictions for burglary.
