SPOKANE COUNTY, June 15, 2021– Pursuant to the provisions of RCW 39.33.010 et seq. Spokane County will hold a virtual public hearing on June 29th, 2021 at 2:00 PM or as soon thereafter, to declare as surplus and dispose of 243 acres, more or less, of real property, Assessor’s Parcel Numbers 15131.0016, 15132.0027, and 15135.0025, collectively hereinafter referred to as the “Raceway Property,” to the Kalispel Tribe of Indians, a federally recognized tribe.

The Raceway Property was operated by Spokane County through a third-party operator’s agreement, but is not currently being held open for public use. The Kalispel Tribe is proposing to use the Raceway Property consistent with its previous use, as a raceway to include, but not limited to a road course, oval track and drag strip.
Any person may appear virtually at the date and time set forth hereinabove, and submit evidence for and against declaring the above Raceway Property surplus and disposing of the Raceway Property to the Kalispel Tribe consistent with the two (2) purchase and sale agreements between Spokane County and the Kalispel Tribe. To ensure that everyone attending has an opportunity to speak at the above scheduled public hearing, testimony may be limited to three (3) minutes per speaker. The Board of County Commissioners reserves the right to adjust the time frame allotted to speakers, as well as hearing procedures, during the hearing.

Background: On May 5th, 2021 Spokane County received two (2) purchase offers from the Kalispel Tribe of Indians to acquire the Spokane County Raceway Property (collectively) for $4,750,000. Pursuant to Washington State law (RCW 39.33.010 and RCW 39.33.020), Spokane County may sell county property directly to a federally recognized tribe, by holding a public hearing on declaring the property “surplus” and the proposed sale.
Subsequently, Spokane County notified the City of Airway Heights of the offer regarding one (1) of three (3) parcels subject to sale, specifically Assessor’s Parcel Number 15132.0027, as they held a First Right of Refusal, which was granted in 2011. The First Right of Refusal was granted as a part of a collaborative agreement which included the extension of City potable water and sanitary sewer services to the site.
The City of Airway Heights had thirty (30) days from the receipt of the offer to decide whether to exercise their First Right of Refusal. On June 4th, 2021, the thirty (30) day period lapsed and ultimately the City of Airway Heights did not exercise its First Right of Refusal.
On June 4th, 2021 Spokane County received an additional unsolicited purchase offer for the Raceway Property (collectively) from a private third-party, George and Kelly Lawrence, for $4,800,000.
On June 14th, 2021 Spokane County received a new bona fide purchase offer from the Kalispel Tribe of Indians specific to two (2) of the Spokane County Raceway Parcels (Assessor’s Parcel Numbers 15135.0025 at 201.3 acres, and 15131.0016 at 14.06 acres) which includes the land, buildings, and some business-related equipment. This new offer for these two (2) parcels has increased to $4,300,000, which would bring the grand total to $5,050,000 for all three of the Spokane County Raceway Parcels (the “Raceway Property”), when combined with the standing May 5th offer of $750,000 for Assessor’s Parcel Number 15132.0027 (27.71 acres).
Spokane County acquired the Spokane County Raceway at auction in 2007. Since that time, the raceway has been operated by three operators, most recently by Raceway Investments, LLC. On March 2nd, 2021, Spokane County terminated the Operator’s Agreement with Raceway Investments, LLC at the request of its owner, Craig Smith.
