On December 6, 2012, at about 3:00 a.m., Spokane County Sheriff's Deputy D. Smith was patrolling the area of Altamont and Lincoln in the Morgan Acres area. Deputy Smith was traveling south on Altamont when he ran the registration of a Ford Taurus in front
of his patrol vehicle. The registered owner of the vehicle, later identified as 42-year-old Leona rd Gilbert, returned with a suspended driving status.
When Deputy Smith learned of the driving status of the registered owner, the vehicle made an abrupt turn onto Houghton road and quickly parked in the driveway of a residence.
Deputy Smith activated his emergency lights and stopped the vehicle. Gilbert walked to the trunk area of the Ford where Deputy Smith contacted him. After confirming it was Gilbert Deputy Smith placed him under arrest for Driving While License Suspended 3rd
Degree. Gilbert admitted he had no idea who lived at the residence.
Deputy Smith searched Gilbert incident to arrest and located a digital scale in his coat pocket with a white powdery residue on the surface. Deputy Smith also located a plastic baggie that contained a chunk of white crystalline substance in his coat pocket.
As Deputy Smith pulled it out, Gilbert said "yeah, that’s meth". The substance field tested presumptive positive for methamphetamine. Deputy Smith was also advised by dispatch Gilbert had two felony warrants for his arrest.
Gilbert was booked into Spokane County Jail for Possession of a Controlled Substance, methamphetamine, and two felony warrants that included the charges of Possession of Stolen Property 1st Degree and Residential Burglary.
