On Wednesday, October 31, 2012, Spokane Valley Sheriff's Deputies responded to the 4400 block of East 5th Street to a residential burglary call. Deputies arrived on scene and contacted a witness in the apartment complex.
The witness told deputies that he heard someone attempting to break into the apartment directly under his. The witness told deputies he did not believe the resident was in the apartment at the time of the attempted break-in. The witness showed deputies a broken
window in the victim's apartment. The witness said when he heard a loud bang in the victim's apartment, he looked out the window and asked the suspect what he was doing. The suspect yelled "police, anyone in there"? The suspect, later identified as 26-year-old
Joseph Mishkin, later told deputies he thought the apartment was vacant and that he needed somewhere to stay.
As the witness was providing a description of Mishkin to deputies, Deputy C. Sciortino saw a subject matching Mishkin's description running behind the apartment complex. He also saw Mishkin take off his sweatshirt and throw it in a nearby yard while he was
running. The witness confirmed it was Mishkin running.
After a short foot pursuit Mishkin was taken into custody. Mishkin initially said he threw his sweatshirt because he did not want to get "beat up or jumped", not because he was attempting to alter his appearance.
• Mishkin was booked into Spokane County Jail on one count of Attempted Residential Burglary and Malicious Mischief.
