Subpoenas

Issuing a Subpoena in an existing Spokane County Case

   
  • A court order is required to be signed in an existing case for the issuance of a subpoena in an existing Spokane County case.
  • A filing fee is due at the time of filing along with an issuance fee for each subpoena.
  • Counsel must provide the subpoenas to be issued along with at least one copy for the court file.
  • Counsel must arrange for service of the subpoenas.

Under the Uniform Interstate Depositions and Discovery Act-

RCW 5.51.020

   

 For Out of State Subpoenas:

  • A Petition entitled  "In the Superior Court of the State of Washington, In and for the County of Spokane". Use the case caption of the case pending in the foreign state. Our office will assign a Spokane County civil case number.
  • A filing fee is due at the time of filing along with an issuance fee for each subpoena.
  • Counsel must provide the subpoenas and incorporate the terms used in the foreign subpoena and contain or be accompanied by the names, addresses, and telephone numbers of the counsel of record in the foreign proceeding to which the subpoena relates and any party not represented by counsel.
  • Counsel must arrange for service of the Subpoenas; the Clerk will forward the issued subpoenas to the service company or the Sheriff if a pre-addressed stamped envelope is provided and prior arrangements made regarding payment to the process server.
